{"id":63,"date":"2017-08-21T14:43:55","date_gmt":"2017-08-21T18:43:55","guid":{"rendered":"http:\/\/canlawblog.com\/?p=63"},"modified":"2017-08-21T14:43:55","modified_gmt":"2017-08-21T18:43:55","slug":"unlawful-assembly-wearing-mask-disguise","status":"publish","type":"post","link":"https:\/\/canlawblog.com\/index.php\/2017\/08\/21\/unlawful-assembly-wearing-mask-disguise\/","title":{"rendered":"Unlawful assembly while wearing a mask or other disguise"},"content":{"rendered":"<p>Unlawful assembly while wearing a mask or other disguise is a criminal offence in Canada, under section 66(2) of the <a href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/FullText.html\" target=\"_blank\" rel=\"noopener noreferrer\">Criminal Code of Canada<\/a>.<\/p>\n<h4 style=\"padding-left: 30px;\">Punishment for unlawful assembly<\/h4>\n<p style=\"padding-left: 30px;\">66 (1) Every one who is a member of an unlawful assembly is guilty of an offence punishable on summary conviction.<\/p>\n<h4 style=\"padding-left: 30px;\">Concealment of identity<\/h4>\n<p style=\"padding-left: 30px;\">(2) Every person who commits an offence under subsection (1) while wearing a mask or other disguise to conceal their identity without lawful excuse is guilty of<\/p>\n<p style=\"padding-left: 60px;\">(a) an indictable offence and liable to imprisonment for a term not exceeding five years; or<\/p>\n<p style=\"padding-left: 60px;\">(b) an offence punishable on summary conviction.<\/p>\n<p style=\"padding-left: 30px;\">R.S., 1985, c. C-46, s. 66; 2013, c. 15, s. 3.<\/p>\n<h2>Why is it illegal to wear a mask in an unlawful assembly?<\/h2>\n<p>Otherwise law-abiding citizens often become violent while wearing a mask.<\/p>\n<p style=\"padding-left: 30px;\">In any violence done by a mask-wearer, the human is not considered responsible; everyone understands the crime was committed by the mask itself.<\/p>\n<p style=\"padding-left: 30px;\"><a href=\"https:\/\/aeon.co\/essays\/how-masks-explain-the-psychology-behind-online-harassment\" target=\"_blank\" rel=\"noopener noreferrer\">https:\/\/aeon.co\/essays\/how-masks-explain-the-psychology-behind-online-harassment<\/a><\/p>\n<p>On August 20, 2017, Blackbloc and Antifa members assembled in Quebec City. They belligerently confronted Quebec French people and<\/p>\n<p>&nbsp;<\/p>\n<p>Some Blackbloc and Antifa members even brutally assaulted an older Quebec Frenchman on the head in Quebec while he carried an old Quebec patriote flag on August 20, 2017.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-64\" src=\"http:\/\/canlawblog.com\/wp-content\/uploads\/2017\/08\/old-french-man-in-quebec-carried-old-quebec-patriote-flag-2017-Aug-20.jpg\" alt=\"Old French man in Quebec carried an old Quebec patriote flag on 2017 Aug \" width=\"620\" height=\"349\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>P flag\u00a0https:\/\/en.wikipedia.org\/wiki\/Patriote_flag<\/p>\n<p>The\u00a0<b>Patriote flag<\/b>\u00a0was used by the\u00a0<a title=\"Patriote movement\" href=\"https:\/\/en.wikipedia.org\/wiki\/Patriote_movement\">Patriote movement<\/a>\u00a0in\u00a0<a title=\"Lower Canada\" href=\"https:\/\/en.wikipedia.org\/wiki\/Lower_Canada\">Lower Canada<\/a>\u00a0(present-day\u00a0<a title=\"Quebec\" href=\"https:\/\/en.wikipedia.org\/wiki\/Quebec\">Quebec<\/a>) between 1832 and 1838.<\/p>\n<p>Some theories about its origins claim that the colour\u00a0<a title=\"Green\" href=\"https:\/\/en.wikipedia.org\/wiki\/Green\">green<\/a>\u00a0was adopted to represent the\u00a0<a class=\"mw-redirect\" title=\"Irish Quebecer\" href=\"https:\/\/en.wikipedia.org\/wiki\/Irish_Quebecer\">Irish of Lower Canada<\/a>, the colour\u00a0<a title=\"White\" href=\"https:\/\/en.wikipedia.org\/wiki\/White\">white<\/a>\u00a0for the &#8220;<a title=\"French Canadians\" href=\"https:\/\/en.wikipedia.org\/wiki\/French_Canadians\">French Canadians<\/a>,&#8221; and\u00a0<a title=\"Red\" href=\"https:\/\/en.wikipedia.org\/wiki\/Red\">red<\/a>\u00a0the\u00a0<a class=\"mw-redirect\" title=\"Anglo-Quebecer\" href=\"https:\/\/en.wikipedia.org\/wiki\/Anglo-Quebecer\">English of the territory<\/a>. Some also say that the\u00a0<a title=\"Tricolour (flag)\" href=\"https:\/\/en.wikipedia.org\/wiki\/Tricolour_(flag)\">tricolour<\/a>\u00a0style was inspired by the\u00a0<a class=\"mw-redirect\" title=\"French tricolour\" href=\"https:\/\/en.wikipedia.org\/wiki\/French_tricolour\">French tricolour<\/a>, symbol of the\u00a0<a title=\"French Revolution\" href=\"https:\/\/en.wikipedia.org\/wiki\/French_Revolution\">French Revolution<\/a>\u00a0that inspired the Patriotes.<sup class=\"noprint Inline-Template Template-Fact\">[<i><a title=\"Wikipedia:Citation needed\" href=\"https:\/\/en.wikipedia.org\/wiki\/Wikipedia:Citation_needed\"><span title=\"This claim needs references to reliable sources. (November 2010)\">citation needed<\/span><\/a><\/i>]<\/sup>\u00a0It became the\u00a0<a title=\"National flag\" href=\"https:\/\/en.wikipedia.org\/wiki\/National_flag\">national flag<\/a>\u00a0of the\u00a0<a title=\"Republic of Lower Canada\" href=\"https:\/\/en.wikipedia.org\/wiki\/Republic_of_Lower_Canada\">Republic of Lower Canada<\/a>\u00a0at the\u00a0<a title=\"Declaration of Independence of Lower Canada\" href=\"https:\/\/en.wikipedia.org\/wiki\/Declaration_of_Independence_of_Lower_Canada\">Declaration of Independence of Lower Canada<\/a>\u00a0in 1838. Currently, it is used by\u00a0<a title=\"Quebec sovereignty movement\" href=\"https:\/\/en.wikipedia.org\/wiki\/Quebec_sovereignty_movement\">contemporary Quebec independence supporters<\/a>\u00a0as a symbol of their movement and ideal.
